ninthsalon.com is published by LDC LMT DIGITAL CREATIONS, a French simplified joint-stock company with a sole shareholder (SASU) with share capital of 1,000 euros.
The site is hosted by Hostinger International Ltd, 61 Lordou Vironos Street, 6023 Larnaca, Cyprus. Account data and generated files are processed through Google Ireland Limited (Firebase), Gordon House, Barrow Street, Dublin 4, Ireland.
Ninth Salon transforms images: you upload a photograph and receive an automatically generated painterly reinterpretation of it. The service is sold as prepaid credits, each credit entitling you to one generation.
Prices are shown inclusive of all taxes, in euros or US dollars depending on the language of the site. The price that applies is the one displayed at the time of order. Prices may change at any time, with no effect on orders already placed.
Payment is processed by Stripe Payments Europe, Ltd. Ninth Salon never receives your card details: they are sent directly to Stripe and never pass through our servers.
Credits are added to your account immediately after payment is confirmed. Generated artworks appear in your gallery as soon as processing completes.
Under Article L221-28 13° of the French Consumer Code, the right of withdrawal does not apply to digital content not supplied on a tangible medium where performance has begun with the consumer's prior express consent and express acknowledgment that the right of withdrawal is thereby lost.
By ticking the box provided before payment, you expressly request immediate delivery of your digital content and waive your fourteen-day right of withdrawal from the moment your credits are used.
Unused credits remain refundable for fourteen days from purchase, on request to contact@ninthsalon.com.
You warrant that you hold the necessary rights to the photographs you upload, and undertake not to submit images depicting other people without their consent, nor any unlawful content. Uploads are screened automatically before processing, and non-compliant images are rejected without consuming a credit.
You retain all rights to your original photograph and may use the generated artwork freely, including commercially. Ninth Salon claims no rights over the artworks produced and will not use them for promotional purposes without your prior written agreement.
The service relies on generative models whose output is inherently variable. Ninth Salon does not guarantee any particular aesthetic result or exact likeness. Our liability is in all cases limited to the amount you actually paid.
These terms are governed by French law. Consumers in the European Union may refer a dispute free of charge to the consumer mediator: [mediator name and contact], or use the European online dispute resolution platform at ec.europa.eu/consumers/odr.
This data is processed to perform the contract: providing the service, managing credits and issuing invoices. Nothing is sold or used for advertising.
The photograph you upload is sent to OpenAI (United States) to generate the artwork. This transfer outside the European Union is covered by the European Commission's standard contractual clauses. We also use Google Ireland (authentication and database), Stripe (payments) and Hostinger (file hosting).
You have the right to access, correct, erase and port your data, and to object to its processing. Write to contact@ninthsalon.com and we will reply within thirty days. You may also lodge a complaint with the French data protection authority, the CNIL.
